These terms and conditions govern your use of our website; by using our website, you accept these terms and conditions in full. If you disagree with any part of these terms and conditions, do not use our website. Please read them carefully as they contain important information.

(1) A contract between you, ‘the buyer’, and Carrick Cooperage, ‘the seller’, comes into force once full payment as outlined on this website has been received by us, ‘the seller.’

(2) Cooperage items are handmade. Whilst we aim to dispatch orders within a maximum of 15 days, depending on stock levels, this may not always be possible. We undertake, therefore, to dispatch your order within 20 working days of purchase or offer a full refund.

(3) Although we take great effort to ensure this information is correct at time of publishing, where we are unable to fulfill an order in accordance with the information stated on this website, we will inform you as soon as possible and provide the option to cancel your order or proceed.

(4) Prices on the site include UK VAT at 17.5%.

(5) Payment for all products must be made by credit or debit card or via a Paypal or Google Checkout account. Personal cheques can be posted but must be cleared before work starts.

(6) We reserve the right to alter the prices stated without prior notice and at any time, but changes will not affect Agreements which have come into force.

(7) We have taken every care in the preparation of this website and its content, in particular to ensure that prices quoted are correct at time of publishing and all products have been clearly and fairly described. We have made every effort to display as accurately as possible the colour options for our products that appear on this website. However, as the actual colours you see will depend on your monitor and its settings, we cannot guarantee that your monitor's display of any colour will accurately reflect the colour of the product on delivery.

(8) To the extent permitted by applicable law, we disclaim all warranties, express or implied, as to the accuracy of the information contained in any of the content on this website. We shall not be liable to any person for any loss or damage which may arise from the use of any of the information contained in any of the content on this website. We cannot accept any liability in respect of any links from this website to other websites we think you may want to visit.

(9) Our product will be at your risk from the time of delivery. Ownership of the product will only pass to you after we have received full payment of all sums due in respect of the Product (including delivery charges).

(10) We warrant to you that any product you purchase through this site will be of satisfactory quality. You warrant to us that: you have full authority, power and capacity to enter into this Agreement and that all necessary actions have been taken to enable you to lawfully enter into this Agreement; you are legally capable of entering into binding contracts; you are resident in the UK or Republic of Ireland; you are at least 18 years old; the information provided in the order you place is accurate; and you will be able to accept delivery of the Product ordered as contemplated in this Agreement. Subject to the warranties set out above, to the maximum extent permitted by applicable law, we disclaim all warranties with respect to the Product, whether express or implied.

(11) Information on this website is provided free-of-charge and you acknowledge that it would be unreasonable to hold us liable in respect of this website and the information on this website. Whilst we endeavour to ensure that the information on this website is correct, we do not warrant its completeness or accuracy; nor do we commit to ensuring that the website remains available or that the material on the website is kept up-to-date. To the maximum extent permitted by applicable law, we exclude all representations, warranties and conditions (including, without limitation, the conditions implied by law of satisfactory quality, fitness for purpose and the use of reasonable care and skill). Our liability is limited and excluded to the maximum extent permitted under applicable Scottish law. We will not be liable for any direct or indirect loss or damage arising under these terms and conditions or in connection with our website.

(12) Nothing in this Agreement shall limit or exclude your or our liability for: (i) death or personal injury caused by negligence; (ii) under section 12 of the Sale of Goods Act 1979, section 2 of the Supply of Goods and Services Act 1982, or section 2(3) of the Consumer Protection Act 1987; (iii) fraud or fraudulent misrepresentation; or (iv) any matter for which it would be illegal to limit or exclude, or attempt to limit or exclude, liability.

(13) Intellectual Property Rights: All rights, including copyright, logos and domain names in our website are owned by Carrick Cooperage & Garden Supplies Limited. You may view, download for cacheing purposes only and print pages from the website for your own personal use, subject to the restrictions below:-

You must not:
(a) republish material from this website (including publication on another website); (b) sell, rent or otherwise sub-license material on the website; (c) reproduce, duplicate, copy or otherwise exploit material on our website for a commercial purpose; (d) edit or otherwise modify any material on the website; or (e) redistribute material from this website except for content specifically and expressly made available for redistribution.

(14) Privacy and Security
We will treat all your personal information that we collect in connection with your Order in accordance with the terms of our Privacy Policy; use of our website will be subject to our Website Terms and Conditions. We never make your personal details available to any third party for marketing purposes. We or our representatives will only hold your data so that your details and/or order can be processed.

(15) Computer Safety. We make every effort to ensure that this website is free from viruses or defects. However, we cannot guarantee that your use of this website or any websites accessible through it won't cause damage to your computer. We shall not be liable to any person for any loss or damage which may arise to computer equipment as a result of using this website.

(16) You have the legal right to cancel your order within seven working days of receipt of the goods (with the exception of made-to-order items).

(17) Once satisfactory delivery has been taken, refunds or exchanges can only be given in accordance with your legal rights. You have up to seven working days after taking delivery to inform us you require a refund. Please contact us at: gillian@carrickcooperage.co.uk and we will inform you of collection options and explain our refunds process. You will be required to keep the item in a resaleable condition. If we collect the item from you, we will charge you the cost of collection.

(18) Faulty Goods – In the unlikely event of you receiving damaged goods, this must be reported in writing to the carrier immediately and to ourselves within 48 hours of receipt. We will then arrange a replacement parts or a full replacement item as we deem necessary.

(19) Law and Jurisdiction. This notice will be governed by and construed in accordance with Scottish law and any disputes relating to this notice shall be subject to the exclusive jurisdiction of the courts of Scotland.

(20) Variations and Changes - We may revise these terms and conditions from time to time. Please check back regularly to ensure you are familiar with the current version. These terms and conditions, together with our privacy policy, constitute the entire agreement between you and us in relation to your use of our website and supersede all previous agreements in respect of your use of this website.
